Orlando-Based Magistrate To Determine Mask Mandate Lawsuit

The Orlando-based magistrate will determine whether the state of Florida must mandate that people don’t walk around town without masks to prevent the spread of infectious diseases.

According to a lawsuit filed in US District Court in Orlando, Florida, Wall, of Washington, DC, was the first to bring action last month, claiming that he is unable to wear a mask due to his generalized anxiety condition. He is suing the CDC, as well as Southwest, Alaska, Allegiant, Delta, Frontier, JetBlue, and Spirit airlines.

Magistrate Judge Daniel Irick of the United States District Court in Orlando is now in charge of the case.

In an email, Wall, 44, said, “I’m confident the court will vacate the illegal and unconstitutional Federal Transportation Mask Mandate, which CDC issued without any authority from Congress and in violation of the constitutional rights to freedom of travel, due process, and states’ rights under the 10th Amendment.” “The Supreme Court declared the Eviction Moratorium unconstitutional, stating unequivocally that the CDC lacked the authority to prohibit evictions during the COVID-19 epidemic. The mask requirement is subject to the same law.”

Wall sued the CDC, President Joe Biden, the Transportation Security Administration, and three other federal agencies on June 7 to get rid of the mandate that all passengers wear masks on all forms of transportation throughout the country.

“In September 2020, President Biden said that the federal government does not have the constitutional power to impose facial coverings,” Wall added. “Yet, like the CDC’s Eviction Moratorium, he went ahead and executed it anyhow – and is now attempting to defend his illegal instructions in court. The court must rein in Biden’s continuous acts in violation of his oath to preserve, maintain, and defend the Constitution.”
